This Request for Proposals (the “RFP”) is an invitation by The Corporation of the Town of Newmarket (the “Owner”) to prospective respondents to submit proposals for a long-term commercial lease of a landmark property at 500 Water Street for use as a as a unique and elevated dining establishment that complements and enhances the existing cultural and economic vibrancy of Newmarket’s Main Street historic district.

Further details regarding the property and the lease opportunity are set out in Part II of the RFP.

The purpose of this RFP is to provide an open and transparent process for the potential selection of a commercial tenant. This RFP is not a procurement process. This RFP is a non-binding selection process and does not create any legal obligations between the Owner and any respondent. The Owner may accept or reject any proposal, and may select the proposal that is in the best interest of the Owner. No contractual relationship will be formed until a lease agreement is entered into between the Owner and a selected respondent. There is no obligation on the part of the Owner or any respondent to enter into a lease agreement. A respondent may withdraw their proposal at any time and the Owner may cancel this RFP process at any time.

The Corporation of the Town of Newmarket (the “Owner”) will ONLY accept ELECTRONIC PROPOSAL SUBMISSIONS submitted through the Owner’s Bidding System here. Proposal submissions received by any other method will be rejected.

The process is free of charge but Respondents must have a Bidding System Vendor account and be registered as a Plan Taker for this bid opportunity, which will enable the respondent to download the RFP document, to receive email notifications, download addendums and to submit their proposal. The Owner’s Bidding System Terms of Service are in Schedule 1 of the RFP.

Proposals must be received by the Owner’s Bidding System no later than 4:00:00 p.m. (16:00:00 hours) local time on July 7th, 2023 (the “Submission Deadline”). Late proposals will not be accepted by the Owner’s Bidding System. The Submission Deadline will be determined by the Owner’s Bidding System web clock. The onus is on respondents to ensure their electronic proposal submission is received no later than the Submission Deadline stated above.

**IMPORTANT: It is the prospective leaseholder / respondent's responsibility to examine and read ALL the documents relating to this file.  It is the responsibility of the respondent to seek clarification on any matter it considers to be unclear by submitting questions through the Owner’s Bidding System before the Deadline for Questions. The Owner is not responsible for any misunderstanding on the part of the respondent concerning this RFP or its process.
